    User banned for content deletion.

    Content restored.

Sorry for posting on an old thread, but isn’t this against GDPR regulations?
    It's unclear:
    https://blog.vanillaforums.com/community-answers-to-common-questions-about-gdpr-community-forums

Q: Is user generated content (UGC) personal data? Is UGC subject to rules around data portability and erasure?

A: This is a tricky one.  What if a member asks that you delete all their posts? What if those posts were valuable both to the community and your company? We feel that if the posts are stripped of identifying information ( for example the username and photo of the member), they do not need to be removed. The exception here is if the posts contain information that identifies the person that is requesting removal. That would also include posts with personal data about the requester that was posted by another member. You might consider laying out in your terms of use or privacy policy who owns UGC and what will be done if someone requests removal of posted content.

Vanilla and most other community forum vendors allow both deleting a member and all their posted content or deleting only the member profile and leaving in place the posts under an anonymized author name.

    and...

Q: Can I keep forum member personal data indefinitely?

A:  The GDPR says you should keep personal data no longer than is necessary for the purpose you obtained it.  It might be reasonable to argue that the data should be kept indefinitely since being a member of a community is not a time-limited task. However, it’s a good idea to periodically review personal data and consider securely deleting unneeded personal data. You might consider deleting member profiles that have been inactive for a very long time.

    and...

Q: What if a banned user makes an erasure request to get removed from the ban list?

A: The GDPR includes the concept of ‘legitimate interests’  where you can retain data if it is in the interest of protecting individuals.  We believe a ban list would fall under legitimate interests.

    Bye!

0reaction image LOL 0reaction image Wow! 0reaction image Wisdom · Share on Twitter
  • That advice on UGC is inaccurate, in two ways. Firstly, UGC is not covered by the GDPR (it only covers personally-identifiable information, which is a condition that most folk who demand that their account and all content be deleted and threaten us with prosecution under the GDPR completely - and wilfully - fail to understand). Also, UGC containing names isn't strictly covered either, because a name is (usually) not sufficient to identify somebody. There's some grey area there, but this is my understanding having spoken to several legal folk who are experts in the matter.

Also, Vanilla has no way to delete all of a user's posted content, because it can't deal with quotes properly.

The last point is an interesting one, given that it's usually banned users who insist that all of their data be removed - it's quite correct in what it says, and it's moderately amusing that those users would have far more traction with it had they just behaved themselves; being banned means we need to retain their information for when they inevitably try to sign up using a sock account.

Incidentally, this is why we never delete IP address tracking information, even if we may - depending on the circumstances - consider a GDPR request to be valid.

    Hiya,

Been considering this for a while now, because I don't know if you've noticed but I'm an arsehole on the internet. Anyway, while this was fine for nihilistic twenty-something me, it's not for less nihilistic forty-something me. I'm actively reducing my visible/searchable public internet contributions.

I'm not going to ask that you delete anything, but I am requesting that you change my username, which I understand to be a bit of a ballache, so apologies. The reason for this is that I post under my own name, which is also extremely distinctive. (Google my username, results 1 through 2,310,000 are me - not really but you get the idea, and TFB results start on page 2). This fulfils the condition of everything I've posted here being identifiable information, and the condition that my name alone is sufficient to identify me. Yes I wish I was called John Smith.

Anyway, rather than invoking GDPR or whatever this can be resolved by changing my username, meaning my posts will no longer appear under my actual name. You can change it to what you like, though I'd prefer "Tex Mexico" if you don't mind.

    Cheers

PS I'm aware I could resolve this by not being an arsehole on the internet. Firstly that doesn't fix having been an arsehole on the internet, and what's more I've tried and giving up fags was easier. And I still smoke.

Well now - ironically, if you now have it changed to Tex Mexico, this thread will link back to your real name and thus negate any point in changing your name.

You really should PM the admin team if you want to request a name change. Although I’m pretty sure that wanting to change it from your real name to another so you carry on being an arsehole isn’t going to win your case over to us.....

Oh, and on the GDPR question..

We hold a very limited amount of personal data. An email address, and a username. Forums that do not have a commercial basis don’t have to re-establish consent, and as such consent for that data is deemed lawful as you are using the account.

You do however, under GDPR have the right to be forgotten (removal of your personal data). Article 17(3) of the legislation makes it clear that your profile must be deleted, but your content doesn’t, as it meets the exemption for freedom of expression and information.

So, if you want your username changed on the grounds of GDPR, then we can of course do that. But you’re then invoking the right to be forgotten - so we anonymise the profile completely, your email address is no longer kept and your username changed. In doing so, of course, we “forget” you, and you lose access to your account - permanently.

So, anyone wishing to insist on a name change for GDPR reasons is asking us to forget them. Permanently. Which of course, we would be happy to do - you just need to be clear that you definitely don’t want to access the site ever again....

To be clear, again I'm not asking to have any data deleted. I was just pointing out that according to the above comments from @digitalscream ; I would be entitled to do so since in its current state all of my data on here meet the criteria of identifying me since they're posted under my quite distinctive real name. A profile name change would seem to be, based on the replies I've seen regarding both processes, the easiest way to resolve this.

To be clear also I'm not requesting a name change in order to enable my future arseholery. I'm acknowledging that I have been an arsehole and will likely be one in the future and I no longer wish to have my actual name written next to past, current or future evidence of this. I'm not a troll, but I am an opinionated bigmouth and I like to argue, and a lot of people don't make the distinction (and arguably why should they). I'm aware that's not an endearing trait, and I would like to have the benefit of relative anonymity that most of this site's users already enjoy.

I would of course prefer to continue to use the site. If however the admin team prefer to respond to my request for a name change with an effective perma-ban, I guess I'm okay with that too as long as the trade-off is that my real name is no longer present or searchable.

I'm comfortable with acknowledging that I'm a complete bell-end on the internet. Most people are, and those who claim not to be are merely smug bell-ends.

However the boring reality is that since I've turned into a responsible adult with a real job there is now a risk, however remote, that my web presence could become subject to professional scrutiny. I realise there are some who believe people should be made to own their internet history, and to be fair if I was a child pornographer or a snuff videographer that might be true. However I just have a habit of taking stupid arguments about irrelevant shit to the point where the above mentioned smug bell-ends start posting pictures of people eating popcorn. I'd rather those arguments not be visible to anyone I have to manage, for example.

Mark, I've noticed a couple of times now you've brought the following things up:

    - Bringing up the username change thing every now and then.
    - Bringing up the lack of development on the video side of things every now and then.

I've ignored prior incidences. But now I wish to address both:

    1. I had ONE name change. From Drew_fx to DrewTNBD. That's because I wanted to separate my worklife from my forum life. The account I use now is not a name change. It's a brand new account. The admins wanted me to use a new account when I came back rather than picking up my old one.

    2. We didn't end up pursuing the Youtube video channel development because of personal things that were going on in my life and in @digitalscream 's life. Consequently we couldn't get our schedules sync'd. I've got a pedal sat here that was meant to be raffled off on the forum. I was going to do a video for it, and we were going to launch it all in unison. Unfortunately this never happened. We fully intended to go into the studio to do that review of the Barefaced cab, but again scheduling and timing stopped this from happening.

I am due to get some pictures over to Lee of this pedal for raffling, but if Lee is amenable to the idea, I'm more than happy to ship the pedal over to you so you can get the Youtube channel kicked off and so you can develop a load of interesting video content for the forum. I'm sure everyone would love that. As for me? Due to job changes, family changes, and priority changes, I no longer have the time or inclination. Sorry.

    Bye!

Most of the stuff you post is great. Put a post-it on your screen saying 'Wait! Is that an arsehole thing to post?' as some kind of early warning system, see if that stops the other stuff.

I've followed this thread for a bit and frankly, its non of my business. However, if one user is allowed a user ID change and a new account to be set up for them, that should apply to everyone. That's not a pop at anyone, it's just a fact.

Admittedly, it's their forum and they can do what they like so we do have to remember that.

Short of policy changes and exceptional circumstances, yes.

The exceptional circumstances involved in previous changes have led to a policy change, which is communicated to anybody who feels they need to change their name, and then they have a choice as to whether they wish to proceed.

The reason it's not made public is that, unlike rule changes, discussion is not required because the policy will not change no matter how people feel about it

Just spotted this one - that's not even remotely true. Quite a few have changed their names, we just don't advertise it because it makes a right mess of the forum if people are constantly changing their names.

There are consequences to doing it, though, which is why a few people have asked for it and then changed their minds.
